IMPORTANT NOTICE


By requesting the services of Zentromarket, you, as the “Sender,” agree on your behalf, on behalf of the “Recipient” of the Shipment, and on behalf of any other party with an interest in the Shipment, that these Terms and Conditions apply.

Shipment” refers to all documents or packages traveling under a single air waybill and which may be transported by any means chosen by Zentromarket, including air, ground, or other carriers.

A “waybill” includes any identifier of the Shipment or document generated by Zentromarket’s or the Sender’s automated systems, such as labels, barcodes, consignment notes, or their electronic versions.

All Shipments are transported under limited liability unless additional insurance is purchased (see Section 8).

1. Customs Clearance and Regulatory Compliance
Zentromarket may perform the following actions on behalf of the Sender or Recipient:

  • Complete documents, correct product or service codes, and advance payment of duties, taxes, or other regulatory charges (“Customs Duties”).

  • Act as an authorized agent or appoint a customs broker.

  • Redirect the Shipment to a customs broker or another requested address.

The Sender/Recipient must provide any additional authorizations required by law.

2. Unacceptable Shipments
A Shipment is considered unacceptable if it:

  • Contains firearms, ammunition, explosives, replica weapons, cash, precious metals, live animals, human remains, illegal drugs, or cannabis products.

  • Is classified as hazardous or prohibited material under international regulations (ADR, IATA, ICAO).

  • Cannot be transported safely or legally.

  • Has an incorrect address or poor packaging.

  • Involves a Sender/Recipient listed on international sanctions lists.

Delivery Time
Shipments are processed on business days and delivered within 24 hours, excluding weekends or public holidays.

3. Deliveries and Undeliverable Shipments

  • Deliveries are not made to P.O. Boxes.

  • Delivery is made to the provided address, not necessarily to the recipient personally.

  • If the shipment is unacceptable, undervalued, the recipient cannot be located, or refuses to pay duties, Zentromarket will attempt to return it at the Sender’s expense.

  • If return is not possible, the shipment may be released, abandoned, destroyed, or sold without liability to Zentromarket.

4. Inspection
Zentromarket may open and inspect a Shipment without prior notice for security, customs, or other legal reasons.

5. Charges, Taxes, and Fees

  • Shipping costs are calculated based on actual or volumetric weight, whichever is greater.

  • Zentromarket may require payment of taxes or fees before delivery.

  • If the Recipient does not pay, the Sender must reimburse all applicable charges.

6. Zentromarket’s Liability

6.1 Liability Limits:

  • For air shipments: up to 22 Special Drawing Rights (SDR) per kg (~USD 30/kg).

  • For international ground shipments: up to 8.33 SDR per kg (~USD 11/kg).

  • Indirect losses (lost profits, income, etc.) are not covered.

  • If greater coverage is desired, additional insurance must be requested (see Section 8).

6.2 Delays:
Zentromarket is not liable for losses due to delays, although limited compensation may apply in certain cases.

7. Claims
Claims must be submitted in writing within 30 days of Shipment acceptance. Only one claim per Shipment is accepted, and the resolution will be final and complete.

8. Shipment Insurance
Additional insurance can be contracted for the full value of the contents, provided the Sender indicates this in writing or during the waybill completion. Insurance does not cover indirect damages or delays.

9. Force Majeure
Zentromarket is not responsible for losses beyond its control, such as:

  • Magnetic damage or data loss.

  • Natural disasters, wars, riots, pandemics.

  • Acts of third parties, cyberattacks, or errors by customs authorities.

10. Sender’s Warranties
The Sender agrees to indemnify Zentromarket in the event of:

  • Shipment not complying with Section 2 restrictions.

  • False or incomplete information about value, contents, or recipient.

  • Breach of customs, export, or international sanctions regulations.

  • Disclosure of personal data without consent.

11. Routing
The Sender agrees that Zentromarket will determine the route and any diversion of the Shipment, including intermediate stops.

12. Governing Law
Any dispute shall be governed by the law of the country of origin of the Shipment, unless otherwise required by law. The Sender agrees to submit to such jurisdiction.

13. Severability
If any clause of these Terms and Conditions is deemed invalid, it shall not affect the validity of the remaining clauses.
